Terms and Conditions for Art+  

These Terms and Conditions (“Terms”) govern the sale and purchase of artworks (“Artworks”) between [Art +] (“Gallery”) and the purchaser (“Buyer”). By purchasing an Artwork from the Gallery, the Buyer agrees to be bound by these Terms.

  1. Authenticity Guarantee:
    • The Gallery warrants that all Artworks offered for sale are authentic and genuine creations, unless otherwise stated. Any claims regarding authenticity must be submitted in writing within 30 days of purchase, accompanied by supporting evidence. The Gallery reserves the right to verify authenticity through independent means.
  2. Provenance:
    • The Gallery provides documented provenance for each Artwork, detailing its history of ownership and exhibition where available. Provenance information is provided in good faith and to the best of our knowledge. The Buyer acknowledges that provenance research is ongoing and subject to change.
  3. Sales and Pricing:
    • Prices for Artworks are as marked and are subject to change without notice. Art + reserves the right to refuse sale to any Buyer.
    • All sales are final. No refunds or exchanges are permitted unless the Artwork is found to be significantly misrepresented or damaged upon receipt.
  4. Payment:
    • Payment for Artworks must be made in full at the time of purchase, unless otherwise agreed upon in writing by the Art+.
    • Accepted payment methods include cash, credit card, bank transfer, or other methods approved by the Gallery.
  5. Delivery and Shipping:
    • The Buyer is responsible for any shipping costs associated with the purchase of Artworks, unless otherwise agreed upon in writing by the Gallery.
    • The Gallery will endeavor to ensure that Artworks are appropriately packaged and shipped in a timely manner. However, the Gallery is not liable for any delays, loss, or damage that may occur during transit.
  6. Copyright and Ownership:
    • The copyright and ownership of Artworks remain with the artist or their estate. The Buyer agrees not to reproduce, distribute, or publicly display the Artwork without prior written consent from the Gallery and the artist or their estate.
  7. Dispute Resolution:
    • Any disputes arising from the purchase of Artworks shall be resolved through negotiation in good faith between all parties. If a resolution cannot be reached, the parties agree to submit to the jurisdiction of the courts of Australia.
  8. Modification of Terms:
    • The Gallery reserves the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Gallery’s website or other communication channels.
